For the purpose of these terms and conditions, please assume the following:

We – refers to Costa Brand Design, a DBA of Matt Costa Marketing, LLC and it’s business.

You – refers to the client, with whom we have been contracted with to do work.

Costa Brand Design reserves all rights to alter or amend these terms and conditions without prior notice.

Number of Revisions

Unless stated otherwise, you are entitled to a specific number of revisions or refinements to the project. This will be outlined before we begin. Any additional work beyond the agreed-upon services will result in additional charges added to your invoice.

Project Termination

Should the contract be terminated by either party, and bills are not settled, all work legally belongs to us – Costa Brand Design – and the client is not permitted to use the designs for personal or business use. In this event, any individual including the client or another designer is not permitted to recreate the ideas or designs created by Costa Brand Design.

Out of Scope

If the scope of the project is altered significantly, we reserve the right, in our sole discretion, to amend the launch date to accommodate the changes to the project. We also maintain the right to decline any work that is not detailed in the original quote requested. 

Website or Design Edits

We are not liable for damages arising from any edits, updates, or changes made by the client to their hosting or site, and/or the original design files provided. If we are asked to assist in resolving such an issue, the time spent will be billed at Costa Brand Design’s current hourly rate.

Ownership

Upon final payment, the client will receive all final file types and the right to display all graphics as they see fit. The client is granted full rights to do whatever they please with the graphics.

Payments

A non-refundable downpayment of at least 50% is required to begin work, if there are additional start-up costs involved for a project like plug-ins, or materials, those costs will be required up-front in addition to the 50% downpayment. The remaining 50% is due before any deliverables are turned over to the client.
